Terms and Conditions

1. Eligibility

Helia is available only to individuals 18 years of age or older. By using the app, the user declares that they meet this requirement.

2. Nature of the service

Helia offers a free plan with basic features and usage limits, as well as a paid subscription (Plant Lover) that increases those limits and unlocks additional features. The prices, limits, and benefits of each plan are shown within the app before any purchase.

Helia offers guidance and educational recommendations related to plant care. No specific results are guaranteed, nor the survival or improvement of plants, even when the provided recommendations are followed.

3. Subscriptions and payments

The Plant Lover subscription is offered as an auto-renewing subscription and is governed by the following terms:

• Billing is processed by the corresponding app store (Apple App Store or Google Play), not by Helia directly.
• The subscription renews automatically for the same period (monthly or annual) unless cancelled at least 24 hours before the end of the current period.
• The renewal amount is charged within the 24 hours prior to the end of the current period.
• You may cancel at any time from your account settings in the App Store or Google Play. Cancellation stops future renewals; you keep access until the end of the period already paid for.
• Refunds are governed by the policies of the corresponding store (Apple or Google). Helia does not process refunds directly.
• Prices may change. Any change will be applied according to the store's rules and, where applicable, you will be notified and/or asked for your consent before it takes effect.

The limits and benefits of each plan (for example, the number of plants and analyses available) are indicated within the app and may be adjusted with prior notice.

4. Use of artificial intelligence

Helia uses artificial intelligence systems to generate responses, messages, and content. Conversations with your plants are generated by artificial intelligence, not by a person or a certified professional. In particular:

• Content is generated automatically
• There is no human review of responses
• Content may be inaccurate, incomplete, or not applicable to your situation
• Helia is not an agronomist, botanist, veterinarian, or other certified professional
• Content does not replace professional advice

The user accepts that they use the information at their own discretion and responsibility.

5. Content and ownership

All content generated, uploaded, or produced within Helia, including photographs, messages, and conversations, is the property of Helia.

The user grants Helia a broad license to:

• Use the content within the application
• Process it through artificial intelligence systems
• Analyze and use it for product improvement and reminders

In case of account deletion, all associated content is permanently deleted in accordance with the Privacy Notice.

6. Limitation of liability

Helia shall not be liable for:

• Direct or indirect damages arising from the use of the app
• Undesired results in plant care
• Reactions or harm arising from handling, ingesting, or contact with plants; Helia does not guarantee the identification of plants toxic to people or pets
• Loss of information
• Technical failures, interruptions, or service errors

The use of the app is at the user's own risk.

7. Modifications

Helia reserves the right to modify these Terms and Conditions at any time. Continued use of the app implies acceptance of such changes.

8. Applicable law

These Terms and Conditions are governed by the laws of the United Mexican States.
